Terms of Service for Tea Chimera

Welcome to Tea Chimera. These Terms of Service ("Terms") govern your access to and use of the Tea Chimera mobile application, website, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use Tea Chimera.

1. Who We Are

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with parental or guardian consent.

By using the Service, you represent that you meet these requirements.

3. Accounts

Account Creation

To access certain features, you must create an account and provide:

a valid email address
a username
a password

You agree to provide accurate information and keep it updated.

Account Responsibility

You are responsible for:

maintaining the confidentiality of your login credentials
all activity that occurs under your account

Notify us immediately at theteachimera@gmail.com if you suspect unauthorized use.

4. Community Features and User Content

Tea Chimera allows users to post recipes, photos, links, comments, and other content ("User Content").

Your Ownership

You retain ownership of your User Content.

License to Tea Chimera

By posting content, you grant Tea Chimera a non-exclusive, worldwide, royalty-free license to:

host
display
reproduce
distribute

your content solely for the purpose of operating and improving the Service.

Responsibility for Content

You are solely responsible for your User Content and agree not to post content that:

violates laws or regulations
infringes intellectual property rights
is defamatory, harmful, abusive, or misleading
contains spam or malicious code

We reserve the right (but not the obligation) to remove content that violates these Terms.

Zero-Tolerance Policy for Objectionable Content

Tea Chimera has a zero-tolerance policy for objectionable content and abusive behavior. The following are strictly prohibited in any User Content, including posts, comments, replies, photos, usernames, and profiles:

harassment, bullying, or personal attacks against any individual or group
hate speech, discriminatory language, or content targeting protected characteristics
threats of violence, incitement, or intimidation
sexual content, nudity, or sexually suggestive material
illegal content of any kind
spam, scams, or deceptive content
impersonation or misrepresentation

We provide in-app tools to report objectionable content and to block abusive users from every post, reply, and profile. See our Community Guidelines for full details and examples.

Moderation and Enforcement

Our moderation team reviews every report within 24 hours. We may, at our discretion and without prior notice, take any of the following actions:

remove objectionable content
temporarily suspend an account (typically 7 days for a first offense)
permanently ban an account
restrict an account's ability to post or comment
cooperate with law enforcement and report illegal content where required

Repeated or severe violations result in permanent removal from the Service. By using community features, you agree to these enforcement actions.

5. Acceptable Use

You agree not to:

use the Service for unlawful purposes
attempt to gain unauthorized access to systems or accounts
interfere with or disrupt the Service
scrape, copy, or harvest data from the platform
impersonate another person

6. Affiliate Links and Third-Party Services

Tea Chimera includes links to third-party tea retailers, including but not limited to:

Arbor Teas, Rishi Tea, Numi Organic Tea, Traditional Medicinals, Yunnan Sourcing, What-Cha, Mei Leaf, Ippodo Tea, Harney & Sons, Adagio Teas, DAVIDsTEA, and The Republic of Tea.

We may earn a commission if you purchase through these links.

We are not responsible for:

products or services provided by third parties
third-party website content
transactions you make with retailers

Your interactions with third parties are governed by their own terms and policies.

7. Intellectual Property

The Service, including its design, branding, features, and content (excluding User Content), is owned by The Tea Chimera Enterprises and protected by intellectual property laws.

You may not:

copy, modify, distribute, or create derivative works
reverse engineer or attempt to extract source code

without our prior written permission.

8. Subscriptions and Communications

You may choose to subscribe to updates or newsletters using your email. You can unsubscribe at any time using the link in emails or by contacting us.

Tea Chimera does not currently offer paid in-app purchases.

9. Termination

You may stop using the Service at any time.

We may suspend or terminate your account if:

you violate these Terms
your conduct harms the community or Service
required by law

Upon termination, your right to use the Service ends immediately.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available."

To the fullest extent permitted by law, Tea Chimera disclaims all warranties, express or implied, including:

merchantability
fitness for a particular purpose
non-infringement

We do not guarantee the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Tea Chimera and The Tea Chimera Enterprises will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless Tea Chimera and The Tea Chimera Enterprises from any claims, damages, or expenses arising from:

your use of the Service
your User Content
your violation of these Terms

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

Any disputes arising from these Terms will be resolved in courts located in Colorado.

14. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we will update the Effective Date and may provide notice within the Service.

Continued use of the Service after updates constitutes acceptance of the revised Terms.

15. Dispute Resolution

Before filing any legal claim, you agree to first contact us at theteachimera@gmail.com and attempt to resolve the dispute informally for at least 30 days.

If informal resolution is unsuccessful, any dispute shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in the State of Colorado. You agree to waive any right to a jury trial or to participate in a class action.

Small claims court actions and requests for injunctive relief are exempt from this arbitration requirement.

16. Force Majeure

Tea Chimera shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to:

natural disasters, acts of God, or severe weather events
epidemics or pandemics
war, terrorism, or civil unrest
government actions or regulations
internet or infrastructure outages
third-party service provider failures

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tea Chimera regarding the Service and supersede all prior agreements or communications.
